Please read these Terms carefully. By downloading, installing, or using the Application, you accept these Terms in their entirety.

Introduction and Acceptance

By accessing PilotDuty and PilotDuty Manager (hereinafter “the Application”), you enter into an agreement exclusively with M2D3V Systems Inc. It is expressly agreed that Apple is not a party to this contract and bears no responsibility regarding the Application or its content. You acknowledge that you have read and accept the provisions below, as well as the applicable Apple Media Services Terms and Conditions.

  1. Scope of License

The license granted to the User is non-transferable and permits the use of the Application exclusively on Apple devices owned or controlled by the User, in accordance with the usage rules outlined in the applicable Apple Media Services Terms and Conditions. This license also allows access by other accounts associated with the purchaser through family sharing or volume purchasing, where permitted.

  1. Maintenance and Support

Maintenance and technical support for the Application are solely the responsibility of M2D3V Systems Inc. The Application is provided “as is,” and Apple has no obligation to provide assistance or support.

  1. Warranties and Limitation of Liability

M2D3V Systems Inc. is solely responsible for all warranties, express or implied, relating to the Application. In case of non-compliance of the Application with any applicable warranty, the User may notify Apple, who will refund the purchase price of the Application. To the maximum extent permitted by law, Apple assumes no further warranty obligations, and any claims, losses, damages, or expenses arising from non-compliance will be the sole responsibility of M2D3V Systems Inc.

  1. Product Claims

Any claims arising from the User or third parties—including product liability claims, non-compliance with legal or regulatory requirements, or consumer protection and privacy—are the sole responsibility of M2D3V Systems Inc. Apple cannot be held responsible for such claims.

  1. Intellectual Property and Defense

All rights relating to the Application (code, design, logos, trademarks, content, etc.) are exclusively owned by M2D3V Systems Inc. In case of a third-party claim alleging infringement of intellectual property rights by the Application, M2D3V Systems Inc. will be solely responsible for the investigation, defense, settlement, and indemnification related to such a claim.

  1. User Legal Compliance

The User expressly declares that they are not located in a country subject to a U.S. government embargo or designated as supporting terrorism, and they are not listed on any U.S. government list of prohibited or restricted parties.

  1. Third-Party Terms

The User agrees to comply with all applicable terms of third-party services used in conjunction with the Application (e.g., mobile data services or other service agreements).

  1. Third-Party Beneficiary

By accepting these Terms, the User acknowledges and agrees that Apple and its subsidiaries are third-party beneficiaries of this agreement. Therefore, Apple may directly enforce these Terms against the User.

  1. Services Offered

PilotDuty and PilotDuty Manager offer services for tracking flight hours, managing duty periods, and flights, relying on real-time location, time, and flight status data. The services are provided “as is” and may be modified at any time.

  1. Eligibility and Registration

To use the Application, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Create an account providing accurate, complete, and current information.
  • Maintain the confidentiality of your login credentials.

You are responsible for all activities conducted from your account.

  1. Data Collection and Use

Using the Application involves collecting the following data:

  • Personal data: name, address, email.
  • Location data: GPS location for flight tracking.
  • Flight-related data: flight status, schedules, and durations.

These data are used to provide our services and are processed in accordance with our Privacy Policy.

  1. Authorized Use

You agree to use the Application in compliance with applicable laws and these Terms. It is prohibited to:

  • Use the Application for illegal, fraudulent, or abusive purposes.
  • Attempt to hack, disassemble, or alter the Application.
  • Share your login credentials with third parties.

Any violation may result in the suspension or termination of your account.

  1. Disclaimer, Limitations, and User Responsibilities

  • Disclaimer for Errors, Omissions, and Issues We are not responsible for errors, omissions, or issues that may arise while using the Application. The Application is solely a facilitation tool, and its use does not guarantee compliance with applicable regulatory requirements.

  • Limitation of Liability We will not be liable for any loss, damage, or injury resulting from the use or inability to use the Application, except in cases of intentional misconduct.

  • User Responsibility for Data Accuracy and Regulatory Compliance Use of PilotDuty and PilotDuty Manager, developed by M2D3V Systems Inc., is strictly limited to managing and maintaining an electronic flight log for aircraft pilots. These applications are facilitation tools and do not replace regulatory checks or safety responsibilities. 

  • Each user must verify, validate, and confirm the accuracy of recorded information, including flight hours, duty periods, location, and real-time flight status. Any inappropriate use—such as fraudulent, abusive, or negligent use—is strictly prohibited. M2D3V Systems Inc. will not be responsible for damages, injuries, or consequences resulting from improper use or incorrect data verification by the user. The user expressly acknowledges sole responsibility for the accuracy of recorded and declared information. 

  • By using the Application, the user agrees to ensure that the data entered are accurate, complete, and compliant with applicable regulatory requirements for pilot logbooks. Failure to comply with this obligation is exclusively the user’s responsibility, and M2D3V Systems Inc. will not be responsible for resulting consequences, including delays, penalties, incidents, or accidents.

  • Right to Suspend or Terminate Services Finally, M2D3V Systems Inc. reserves the right to suspend or terminate access to its services for non-compliance with these Terms, without notice or compensation.

  1. Account Termination

We reserve the right to suspend or terminate your access to the Application for non-compliance with these Terms, without notice. You may also terminate your account anytime by deleting the Application and contacting us via the provided contact details.

  1. Updates and Modifications

We reserve the right to modify these Terms anytime to reflect changes in our services or legal requirements. Changes will be posted on this page. Continued use of the Application after publication signifies acceptance of the updated Terms.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of Quebec, Canada. Any dispute regarding the Application will be submitted to the exclusive jurisdiction of Quebec courts.

Final Acceptance By using the Application, you acknowledge having read, understood, and accepted these Terms, including specific provisions relating to Apple’s requirements.
